Talcum Powder Lawsuits Headed For Consolidation- MDL Status

A talcum powder lawsuit motion has been filed with the U.S. Judicial Panel on Multidistrict Litigation (JPML) seeking  to  consolidate  all  ovarian cancer lawsuits  in a single court, under one judge  in order to coordinate pretrial proceedings and make the process easier.  The chosen venue  suggested is the  U.S. District Court, Southern District of Illinois.

The motion claims  that the current ovarian cancer  plaintiffs reside in several different states and that the Southern District of Illinois would permit convenient travel for the parties and counsel.

Black woman often  used talcum powder  for her  their entire adult life. These products seemed safe, after all, mothers used talcum powder on their babies, right? Using Talcum Powder products were a part of being in with the other girls. Yet, as far back as 2005 Fred Hutchinson Cancer Research Center did a study  about these products. Another study   was published in 1997. The studies suggested  there might  be a connection between talcum powder use  and ovarian cancer.

New Drugs for Advanced Ovarian Cancer

In 2014, the Food and Drug Administration (FDA) approved the first of a new class of drugs, called PARP inhibitors, to treat advanced ovarian cancer (cancer that has spread beyond the ovaries and pelvic area).

The new drug, called Lynparza (olaparib), is taken as a pill.

Lynparza is recommended for women with both advanced ovarian cancer and an inherited BRCA1 or BRCA2 gene mutation who have undergone three or more previous rounds of chemo.

In a small clinical trial, about one-third of the women who got the new drug had their tumors shrink or disappear for an average of about eight months.

J & J Seeking A Consolidated MDL For Baby Powder Lawsuits

The fact that J & J is seeking consolidation would imply they think 1000’s of lawsuits are coming.  Given that ovarian cancer is on the rise we can see the concern. After all, how many women used and are still using their talc product down there.

Since commonality is also an required element for a class action, class actions are frequently litigated in MDL proceedings.
